N-TUTORR Student Privacy Statement

This Privacy Statement sets out how your personal data, collected during your participation in one of the N-TUTORR projects described in the Annex (below), will be processed.

1.         WHO IS COLLECTING YOUR PERSONAL DATA?
1.1       In the course of your participation in a project, the University/Institute in which you are enrolled will process certain categories of information which it obtains from you. It is not possible to enable you to participate in any of the projects to which this Statement relates without collecting that personal data from you.  

1.2      Some projects may use a digital platform. Once you have accessed the project’s digital platform, the University/Institute is the controller of the personal data that is collected from you during your participation in the project. A separate, verification system may be used to enable you to access the digital platform for the project.

2.         WHY DO WE COLLECT YOUR DATA AND WHAT IS OUR LEGAL BASIS FOR DOING SO?
2.1       The purpose for which your personal data will be processed during your participation in a project is to enable your identity to be verified, to record and assess your participation in the project and to make awards.

2.2       The University’s/Institute’s legal basis for processing that personal data is section 9 of the Technical Universities Act, 2018, which confers on the University/Institute the function, inter alia, of providing programmes of education and training that reflect your needs and those of other stakeholders and facilitate learning by flexible means.     

3.         WHAT DATA DO WE COLLECT?
3.1       The information that may be collected during your participation in a project includes your:

·        name
·        email address
·        telephone number
·        date of birth
·        gender
·        voice
·        image
·        user name and password
·        IP address
·        enrolment details at the University/Institute
·        education and training records
·        test results and assessments
·        educational awards. 

3.2      In the course of a project, a survey may be conducted which will seek special category
personal data revealing racial or ethnic origin, an individual’s gender, and sexual orientation.

Where such a survey is conducted, the special category data collected will be pseudonymised before being used. This means that the results of the survey will be anonymous but that the source information may be retained securely by the person who carried out the survey as means of verifying the statistics resulting from the survey. 

4.         WITH WHOM DO WE SHARE YOUR DATA?
4.1       The personal data collected during your participation in a project will not be provided to any third party save as set out hereunder.

4.2        The award to you of a digital badge will be processed through the Open Badge Factory platform and will be accessible on the Moodle VLE.

4.3        The Universities/Institutes are required to provide statistical data to the European Commission which is funding the projects. This includes data in connection with the gender, age, employment status of the students and the type of education or training concerned of participants in the projects.

That statistical information will be collated by the Technical Higher Education Association (THEA), which is administering the projects on behalf of the Universities/Institutes. THEA will, for this purpose, process the personal data forwarded by the Universities/Institutes which will have been collected from you. THEA will anonymise the personal data before forwarding the statistical data to the European Commission.

4.4       Should it become necessary to transfer the personal data collected during your participation in a project to a Processor outside the European Economic Area, this will only be done in accordance with the provisions of the General Data Protection Regulation.  

5.         FOR HOW LONG DO WE KEEP YOUR DATA?
5.1       The University/Institute retains personal data gathered in the course of your participation in a project for as long as is necessary for the purposes of your participation in the project.  

5.2       The personal data collected in the course of your participation in a project will not be retained for more than 7 years.   

6.         HOW DO WE KEEP IT SAFE?
6.1       Your personal data will be stored securely on the University’s/Institute’s premises or on secure IT platforms within the European Economic Area. The University/Institute uses appropriate administrative and technical measures to safeguard your personal data against loss, theft, and unauthorised access, uses and modifications.

6.2       Those projects that require a digital platform will engage a Processor to process the personal data that may be collected during your participation in a project.   

7.         WHEN DO WE USE AUTOMATED DECISION MAKING?
7.1       The Digital Backpack involves automated decision making. If you engage with the online course on the Digital Backpack, an algorithm will be applied which will verify the correctness of any replies you give to questions posed as part of the course. You will be awarded marks as a result of the processing of your replies by the algorithm. This will result in the award of a digital badge to you where sufficient correct answers are given.   

8.         WHAT ARE YOU YOUR RIGHTS AS A DATA SUBJECT?
8.1       Under the General Data Protection Regulation you have specific rights over how personal data relating to you is processed when you participate in a project. These rights are not absolute and may be subject to exemptions.

8.2       Right of Access - You have the right to request a copy of the personal data which is under the control of the University/Institute and to exercise that right easily and at reasonable intervals. A Data Access Request Form is available from the DPO office in your institution of enrolment.

8.3       Rectification - You have the right to have inaccuracies in your personal data held by theUniversity/Institute rectified.

8.4       Erasure - You have the right to have your personal data deleted where there is no reason for the University/Institute to retain it, subject to exemptions such as the use of pseudonymised or anonymised data for scientific or research purposes.

8.5        Object - You have the right to object to the processing of your personal data collected during a project if you believe the processing to be disproportionate or unfair to you or if the personal data is used for a purpose other than that for which it was collected.

8.6        Restriction - You have the right to restrict the processing of your personal data if you are contesting the accuracy of the personal data, the personal data was processed unlawfully, you need to prevent the erasure of the personal data in order to comply with legal obligations or you have objected to the processing of the personal data and wish to restrict the processing until a legal basis for continued processing has been verified.

DETAILS OF PROJECTS 

Projects/Work Packages 

WP1.1: Sustainable pathways to HE
This work package rethinks lifelong learning to transform learning and teaching through flexible pathways to higher education that provide opportunities for engagement that include micro-credentials, part-time and blended learning programmes.

It will build the strong access track record in the technological higher education sector to provide more opportunities for more learners to access higher education in more ways. It will contribute to an enabling culture that will empower lifelong learning participation, providing opportunities for learners from vulnerable and marginalised groups to access higher education opportunities through flexible course provision.  

Access is a first step, whole-of institution approaches are needed to support participation and success for all learners - more flexible and responsive student support is an important element of the work package. The work packages include complementary measures such as Universal Design for Learning (UDL) to promote participation and success for all learners. 

WP1.2: Empower students to become change agents
This work package foregrounds student empowerment and community building. It aims to transform learning and teaching by empowering students to become change agents and to build capacity for meaningful student-staff partnership across the sector.

It will involve co-creating with students, inclusive schemes and initiatives that support and enhance student engagement and partnership activities and develop models of good practice to support ongoing transformation. 

WP1.3: Academy for Education for Sustainability, Leadership & Employability
This work package provides flexible, accessible self-directed learning pathways to empower students to build a Digital Backpack of credentials and to learn and develop skills focused on global priorities and challenges.

This package also provides opportunities for students to develop skills and literacy in sustainability and global citizenship, digital identity and transformation, EDI and mental health and well-being.

In addition, a Sustainable Futures Ambassador programme will empower students to drive change and engagement with the Digital Backpack.

The ambassador programme connects with work package two ‘Fellowship Scheme’ in Stream 1, where students are empowered to drive change and engagement, at a university level, across the region and on a national level. 

Stream 3: Enable Digital EcoSystems Projects/Work Packages 

WP3.1: Sustainable Learning & Pedagogical Environment: Enable digital examination/assessment embedding academic integrity
This work-package consists of four constituent yet related components proposed to achieve the scale and scope of sustainable transformation of the pedagogical and learning environment facilitated by the use of digital infrastructure that assures the diversity, equity, and inclusiveness in the areas of examination, assessment, academic integrity and research ethics including:

(I) A digitally enabled Assessment/Examination Management System & Repository
(II) A Proctored e-Assessment/e-Examination Management System
(III) A Research Ethics Application Management System  
(IV) Digitally enabled Academic Integrity solutions and toolkits for students and staff, which include:
a. Software solutions
b. A Knowledge Repository/Portal
c. Student and Staff Academic Integrity Training. 

WP3.2: Digital Campus
The holistic results of the digital campus work-package constitute a transformative change in the way in which teaching, learning and assessment services and supports are organised and provided to learners.

Hybrid learning and Media/Delivery Spaces broaden access to campus programmes for learners who cannot, for whatever reason, commit to attending campus while also addressing the needs of a more diverse learner group than ever before.

Initiatives such as a sustainability education programme are provided with an essential ecosystem to support sector-wide access and capacity.

This work package is concerned also with providing capacity and resilience for future emergencies which require the full or partial physical closure of campuses and with providing the sector as a whole with deep preparedness for other kinds of continuity and performance challenges.

WP2.1: Sectoral level support of the developmentof staff capabilities within a sustainable HE framework 
This Work Package will establish a sectoral Sustainable Higher Education Framework Steering Group/Community of Practice tasked with the project coordination and overall management of the work package.

It will determine baseline activity across the sector in terms of staff capability within the context of supporting the transformation of learning, teaching and assessment against a sustainable education framework and to scope out and advise on a toolkit to support staff transformation.

It will implement a team of Sustainable Higher Education Futures Champions across the sector and design, develop, implement, and support accredited provision for staff through a digital badging system. 

WP2.2: Development of a transformative sustainable HE curriculum framework
This work package focuses on curriculum development and enhancement through embedding of Universal Design for Learning (UDL), digitally enabled content delivery and assessment to support the development of graduate capabilities for digital transformation, resilience and sustainability in HE.

WP2.3: Develop capabilities of all staff (Academic & PMSS) to support transformative sustainable HE & resilience
This work package concerns itself with developing the capabilities of all staff working in the technological sector with a particular emphasis on teaching, learning and assessment and digital transformation, resilience, and sustainability.

As such, this work package aims to establish a baseline of staff digital capability and leading from this to plan, coordinate and recognise staff engagement with professional development activities, both on a national and institutional level. Here, staff includes academic teaching staff,technologists, learning technology staff, and professional services staff.

The objective of this theme is to build staff capability to support digitally enabled student learning and services with the view of transforming HEI capacity to support holistically the student experience addressing all aspects of their engagement with learning, teaching and assessment and within a sustainable higher education framework.
